Candidate Qualifications & Petitions

A complete guide to nominating petition procedures and the statutory qualifications required to hold public office in Tennessee and Hamilton County.

Nominating Petition Procedures

⚠️ The Noon Deadline: All nominating petitions and any required supporting documents must be filed before 12:00 Noon on the date of the Qualifying Deadline in the Hamilton County Election Commission Office to appear on the upcoming ballot. While petitions must be filed before 12:00 noon, T.C.A. § 2-5-101(d) mandates that the election offices where petitions are to be filed shall remain open until 4:00 p.m. prevailing time on the final day of any qualifying period. The State of Tennessee does not use filing fees.

1. Issuing the Petition

  • Petitions must generally be obtained from the Hamilton County Election Office. However, T.C.A. § 2-5-102(b)(2) permits nominating petitions for certain state and federal offices to also be obtained from the office of the state coordinator of elections.
  • Candidate's name and office sought must be completed at the time of issuance (no titles permitted).
  • Anyone may pick up or return the petition, but only the candidate may complete the candidate's section and sign each page.
  • Petitions are public records. No photocopies are accepted; if lost, a new original must be obtained.

2. Circulating for Signatures

  • Requires 25 valid signatures (excluding the candidate) of eligible voters. (50 recommended). Exception: Independent presidential candidates require signatures from the candidate and twenty-five (25) or more registered voters for each elector allocated to the state (T.C.A. § 2-5-101(b)(1)).
  • Voters must sign their own name. Per T.C.A. § 2-1-107(c), a person's regular signature shall be accepted just as their legal signature would be (e.g., "Joe Public" is acceptable for "Joseph Q. Public"). Spouses cannot sign for each other.
  • Voters unable to sign due to disability require two (2) witness signatures.
  • Voters must list their correct residential address (PO Boxes are not accepted).

3. Filing & Status Process

  • A postmark does not satisfy the filing deadline. You will receive a receipt upon physical filing.
  • The Commission will notify you in writing if the petition met the required signatures.
  • Special affidavits must be filed for Sheriff, Road Superintendent, and Constables. School board candidates are required to file proof of high school graduation or receipt of a GED.
  • Candidates for judicial offices requiring an attorney must certify their licensure and place their state Supreme Court registration number directly on the nominating petition (T.C.A. § 2-5-106(a)).
  • Felony convictions mandate rights restoration by a court. Note: T.C.A. § 40-20-114(b) permanently disqualifies any individual from holding public office if their infamous crime was committed in their official capacity or involved the duties of their office, even if other citizenship rights have been restored.

4. Withdrawal Process

  • Deadlines: The general withdrawal deadline is 12:00 noon on the seventh day after the qualifying deadline (T.C.A. § 2-5-204(b)(1)). However, candidates qualifying under extended statutory deadlines must file any withdrawal request no later than 12:00 noon on the third day after the qualifying deadline.
  • Submission Method: A written request bearing the candidate's original signature must be filed physically. While the original notice may not be faxed or phoned to the candidate's county of residence, a copy may be faxed to other applicable counties wholly or partially within the district once the original has been properly filed.

General Qualifications (TCA § 8-18-101)

All persons 18 years of age who are US and TN citizens and have met the residency period required are qualified to hold office, EXCEPT:

  • Those convicted of bribery, larceny, or any infamous crime (unless rights are legally restored). Exception: Individuals convicted of an infamous crime are permanently disqualified from holding public office, even if their citizenship rights have been restored, if the offense was committed in the person's official capacity or involved the duties of their office.
  • Those with an unpaid judgment for moneys received in an official capacity due to the US, State, or County.
  • Those who are defaulters to the treasury at the time of election.
  • Soldiers, seamen, marines, or airmen in the regular army or navy or air force of the United States.
  • Members of congress and persons holding profit/trust under foreign powers, other states, or the US.

Causes of Vacancies (TCA § 8-48-101)

Any office in this state is vacated by the following:

  • Death or legally permitted resignation.
  • Ceasing to be a resident of the state, district, circuit, or county for which elected/appointed.
  • Decision of a competent tribunal declaring the election void or office vacant.
  • Act of the general assembly abridging the term of office (if not fixed by constitution).
  • Sentence to the penitentiary by a competent tribunal (subject to restoration if reversed, but not if pardoned).
  • Adjudication of the incumbent's insanity.

Specific Qualifications for Office

Federal & State Offices

United States President

  • 35 years of age.
  • Natural-born citizen.
  • Resident within the United States for 14 years.

United States Senator & Representative

  • Senator: 30 years of age; US Citizen for 9 years; TN resident.
  • Representative: 25 years of age; US Citizen for 7 years; TN resident.
  • Primary Requirements for both: Under T.C.A. § 2-13-209, to qualify as a candidate in a primary election, a person must meet the residency requirements for state senators and representatives (3 years of state citizenship and 1 year of county residence).

Governor

  • Basic qualifications of TCA § 8-18-101.
  • At least 30 years of age, a US citizen, and a TN citizen for 7 years before the election.

State Senator & State Representative

  • Basic qualifications of TCA § 8-18-101. Qualified voter of that district.
  • Senator: 30 years of age; US citizen; TN resident 3 years; county/district resident 1 year immediately preceding election.
  • Representative: 21 years of age; US citizen; TN resident 3 years; county/district resident 1 year immediately preceding election.
    Note: While the Tennessee Constitution requires a representative to be a resident in the county they represent for one year, T.C.A. § 3-1-104 specifies that in counties entitled to elect two or more direct representatives that are divided into representative districts, candidates are not required to reside in the specific representative district from which they seek to be elected, provided they are a resident of the county.

State Executive Committee

  • Basic qualifications of TCA § 8-18-101.
  • Bona fide members of the political party whose election they seek.
  • Voters in each senatorial district shall elect one man and one woman per party.
Judicial & Legal Offices

TN Supreme Court & Appellate Judges

  • Basic qualifications of TCA § 8-18-101. Learned in the law (authorized to practice in TN).
  • Supreme Court: 35 years of age; state resident for 5 years.
  • Court of Appeals / Criminal Appeals: 30 years of age; state resident for 5 years; must reside in the grand division of the state from which they seek election.

Chancellor, Circuit, & Criminal Court Judges

  • Basic qualifications of TCA § 8-18-101. Learned in the law.
  • 30 years of age; state resident for 5 years; circuit/district resident for 1 year.

General Sessions & Juvenile Court Judges

  • Basic qualifications of TCA § 8-18-101. Licensed to practice law in TN.
    Exception: T.C.A. § 16-15-5005(a)(2) provides a grandfather exception permitting any person serving as a general sessions judge on August 1, 1990, who is not a licensed attorney, to seek reelection and serve. Furthermore, T.C.A. § 17-1-106 designates certain counties by population brackets where general sessions judges are entirely excluded from the requirement to be licensed attorneys.
  • 30 years of age; state resident for 5 years; circuit/district resident for 1 year.

District Attorney General & Public Defender

  • Basic qualifications of TCA § 8-18-101. Duly licensed attorney in TN.
  • State resident for 5 years; circuit/district resident for 1 year.
County Offices

All below offices require the basic qualifications of TCA § 8-18-101.

County Mayor / Executive

  • Qualified voter; 25 years of age; county resident 1 year prior to qualifying deadline.
  • Shall not hold any other public office for profit during term.

County Commission

  • County resident 1 year prior to deadline. Reside within and be a qualified voter of the district represented.
  • T.C.A. § 5-5-102(c)(2) explicitly disqualifies any person from being nominated or elected to the county legislative body if they have been elected or appointed to fill a county-wide office, such as county mayor, sheriff, trustee, register, county clerk, or assessor of property. Additionally, a director of schools is statutorily disqualified from serving as a member of the county legislative body.

Sheriff

  • US Citizen; 25 years of age; qualified voter; county resident 1 year.
  • High school diploma or GED equivalent.
  • Cannot practice law or serve in the general assembly.
  • No convictions/pleas for domestic violence misdemeanors, felonies, or laws relating to force, theft, dishonesty, gambling, liquor, or controlled substances/analogues.
  • Must be fingerprinted by the TBI. Must not have been released, separated, or discharged from the Armed Forces of the United States with a Dishonorable or Bad Conduct discharge, or as a consequence of conviction at court martial for either state or federal offenses (T.C.A. § 8-8-102(a)(7)).
  • Must pass psychological evaluation (DSM III standards).
  • Must have at least 3 years of full-time POST-certified law enforcement experience in the past 10 years (applies in Hamilton County).
    Exception: T.C.A. § 8-8-102(a)(9)(B) provides an exception to this POST requirement for any county having a metropolitan form of government where the sheriff does not have full law enforcement powers.
  • Must file affidavit and psych evaluation with POST Commission.

Trustee, Register of Deeds, & Clerks

  • Qualified voter; resident of county 1 year prior to deadline.
  • Circuit Court Clerk must reside in the county wherein the court is held.
  • Must continue to reside within the county; ceasing to be a resident of the county for which they were elected or appointed automatically creates a vacancy in the office (T.C.A. § 8-48-101).

Assessor of Property

  • Qualified voter; county resident 1 year.
  • No member of the county legislative body is eligible.

Highway Chief Administrative Officer

  • Qualified voter; county resident 1 year.
  • High school diploma or a high school equivalency credential approved by the state board of education AND one of the following: Licensed engineer, graduate of accredited engineering school with 2 yrs experience, equivalent combination, or 4 yrs supervisory experience in highway construction/maintenance.
  • Must file affidavits with the TN Highway Officials Certification Board 14 days prior to deadline.

County School Board

  • Qualified voter; county resident 1 year. Reside in district represented.
  • Proof of high school graduation or GED filed with election commission.
  • No county legislative member or other county official is eligible.

Constable

  • 21 years of age; qualified voter of district; county resident 1 year. High school diploma/GED.
  • No felony convictions. Honorable military discharge if applicable.
    Exception: T.C.A. § 8-10-102(a)(1)(E)(ii) waives the honorable military discharge requirement for individuals who have served in the office of constable for ten or more years in counties within a specific population bracket (18,200 to 18,500).
  • Must file an affidavit and a letter from a licensed psychologist stating mental/cognitive fitness. (Note: Grandfather clauses exist for constables elected prior to July 1, 2023).
Municipal Offices

City of Chattanooga

  • Mayor: Resident of the city for 1 year prior; 30 years of age.
  • Council: 21 years of age; resident of district for 1 year prior.
  • Judge: Licensed attorney; TN citizen & city resident for 1 year prior.
  • All Popularly Elected Offices: Must not have a direct or indirect interest in any contract with or franchise from the city.
  • Disqualification: Individuals convicted of a felony are disqualified from holding elective office unless their full citizenship rights, including the right to suffrage, have been legally restored.

City of Collegedale

  • Commission: Qualified voter of the city.
    • Exception: A person qualified to vote based solely on nonresident ownership of real property is not eligible to serve as a commissioner (T.C.A. § 6-20-103).
    • Disqualification: Permanently disqualified from serving as a commissioner if convicted of malfeasance in office, bribery, or other corrupt practice (T.C.A. § 6-20-104).
  • Judge: Licensed attorney; 30 years of age; resident of the county.

City of East Ridge

  • Mayor & Council: 21 years of age; citizens of the United States and the State of Tennessee; resident/registered voter of city for 1 year; no conviction of crime involving moral turpitude; cannot have a direct personal interest in any contract with the city.
  • Court Clerk: 21 years of age; resident/registered voter of city for 1 year; no conviction of crime involving moral turpitude.
  • Judge: 30 years of age; licensed attorney; TN resident 5 yrs and resident of Hamilton County for at least 1 yr prior to qualification (must remain a resident of Hamilton County as long as they serve); no conviction of crime involving moral turpitude; hold no other nonjudicial elected office.

City of Lakesite

  • Commission: Qualified voter of the city.
    • Exception: A person qualified to vote based only on nonresident property ownership is ineligible for election as a commissioner (T.C.A. § 6-20-103).
    • Disqualification: Disqualified from the office of commissioner if convicted of malfeasance in office, bribery, or corrupt practice (T.C.A. § 6-20-104).

Town of Lookout Mountain

  • Commission & School Board: Resident, qualified voter, and bona fide citizen of the town for 1 year prior.
  • Judge: Licensed attorney; 30 years of age; TN resident 5 yrs and Town resident 1 yr prior. Must meet all the qualifications of an inferior court judge as required by Article VI, Section 4 of the Constitution of Tennessee.

City of Red Bank

  • Commission: Qualified voter of the city and a resident of the district. Disqualification: Candidates are disqualified if they have been convicted of malfeasance in office, bribery, or other corrupt practice (T.C.A. § 6-20-104).
  • Judge: Licensed attorney; 30 years of age; resident of the county.

City of Ridgeside

  • Commission: TN citizen and resident of the city for 1 year prior. Note: Any commissioner who moves their residence outside the city boundaries immediately vacates their office and is no longer qualified to serve.

Town of Signal Mountain

  • Town Council: Registered voter, resident, and bona fide citizen of the Town. (Applies to Mayor and Town Council members).
  • Judge: Registered voter in the town; 30 years of age; licensed attorney; TN resident 5 yrs and Town resident 1 yr. Restriction: Strictly ineligible to hold any other elective offices for the Town of Signal Mountain, or to hold any other position of employment with the Town of Signal Mountain.

City of Soddy Daisy

  • Commission: Qualified voter of the city.
    • Exception: A person qualified to vote based only on nonresident ownership of real property is not eligible to serve as a commissioner (T.C.A. § 6-20-103).
    • Disqualification: Disqualified from the office of commissioner if convicted of malfeasance in office, bribery, or corrupt practice (T.C.A. § 6-20-104).
  • Judge: Licensed attorney; 30 years of age; resident of the county.

Town of Walden

  • Mayor: Must reside within the municipality for 1 year prior to election (T.C.A. § 6-3-103).
  • Alderman: Must reside within the specific ward they represent for at least 1 year next preceding the election (T.C.A. § 6-3-103).

Primary Candidate Information

If you want to run in a political party's primary election, it is your responsibility to contact that party directly. Each state party has its own rules for who can run. If you do not meet those rules, the party may decide not to let you be a candidate.

Statutory Rules & Exceptions

  • Bona Fide Membership: T.C.A. § 2-13-104 dictates that all candidates for the general assembly and state executive committee must be bona fide members of the political party whose election they seek, and permits parties to explicitly require by rule that candidates for its other nominations be bona fide members of the party.
  • Military Exception: The statutory exception found in T.C.A. § 2-13-115 dictates that an honorably discharged veteran, National Guard member, or inactive reservist in good standing must not be disqualified as a candidate if they were unable to comply with the party's rules for candidacy solely for service-related reasons.
  • Disqualification Process: If a political party decides to disqualify a candidate under its rules, T.C.A. § 2-5-204(b)(2)(A) requires the party's executive committee to file its determination with the state coordinator of elections no later than 12:00 noon prevailing time on the seventh day after the qualifying deadline.
